These Terms of Use govern your access to and use of Radio Theater AI and any related websites, applications, APIs, features, and services provided by or on behalf of Radio Theater AI (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time. Your continued use of the Service after changes become effective means you accept the updated Terms.
2. Description of Service
The Service allows users to submit prompts, images, and related materials to generate AI-assisted video and media outputs using third-party AI systems and related infrastructure. Some features may require an account, credits, or payment.
3. Third-Party AI Services Disclaimer
The Service may rely on third-party AI providers, infrastructure, and model outputs, including providers such as x.ai or similar services. We do not control those third-party systems and are not responsible for their availability, performance, filtering, moderation, retention, security, or output behavior.
4. User Responsibility for Inputs and Outputs
You are solely responsible for all prompts, uploaded images, reference materials, account activity, generated outputs, downloads, sharing, publication, distribution, sale, and any other use of content produced through the Service. You assume all legal risk arising from your use of the Service and from any content you submit or generate.
5. AI Output Disclaimer
AI-generated outputs may be inaccurate, offensive, misleading, unexpected, incomplete, low quality, infringing, inappropriate, unsafe, or unsuitable for any purpose. Output may also vary significantly even when prompts are similar. We do not endorse, warrant, or guarantee any output.
6. Prohibited Uses
You may not use the Service to create, request, upload, generate, publish, distribute, or facilitate content that is illegal, harmful, exploitative, infringing, defamatory, harassing, hateful, discriminatory, obscene, sexually explicit, non-consensual, deceptive, or otherwise objectionable.
Without limitation, you may not use the Service for:
- Illegal or fraudulent activity.
- Harassment, intimidation, or threats.
- Sexual exploitation, abuse, or non-consensual imagery.
- Deepfakes, impersonation, or deceptive likeness use.
- Privacy violations, doxxing, or unauthorized disclosure of personal data.
- Copyright, trademark, publicity-right, or other intellectual property violations.
- Defamatory or misleading content.
7. User Representations and Warranties
You represent and warrant that you have all rights, licenses, consents, permissions, and releases needed for every prompt, image, likeness, voice, name, character, trademark, copyrighted work, person, or other material you submit or reference. You also represent that your use of the Service complies with all applicable laws and third-party rights.
8. Uploaded Images, Prompts, and Releases
You must not upload any image or provide any prompt unless you have the legal right to do so. You are responsible for obtaining any consent or release required for the use of another person’s likeness, voice, image, or identity, including in synthetic or edited form.
9. Generated Content Ownership Disclaimer
To the maximum extent permitted by law, Radio Theater AI does not make any promise that generated content is original, exclusive, non-infringing, or safe to use. Similar or identical outputs may be generated for other users. You are responsible for determining whether any output can legally be used for your intended purpose.
10. No Guarantee of Exclusivity
We do not guarantee that any prompt, image, style, or concept you submit will produce a unique output. The same or substantially similar outputs may be generated for other users now or in the future.
11. Content Moderation and Rejection
We may review, block, refuse, limit, delay, remove, or reject any prompt, image, account, or output at any time for safety, legal, operational, abuse-prevention, or policy reasons. We may also suspend or terminate access if we believe a user has violated these Terms or exposed us to risk.
12. Credits, Payments, Refunds, and Failed Generations
Credits are consumed when generation begins. If a generation fails, is rejected, or is otherwise handled by our internal failure or refund policy, any refund will be handled according to the Service logic in effect at that time. We may revise credit amounts, pricing, or policies at any time to the extent permitted by law.
13. Account Suspension and Termination
We may suspend, restrict, or terminate your account at any time, with or without notice, if we believe you violated these Terms, abused the Service, attempted to evade moderation, or created legal or security risk for us, our users, or third parties.
14. DMCA / Copyright Complaints
If you believe content on the Service infringes your copyright, contact us at the address listed below with sufficient detail to evaluate the request. We may require additional information, a sworn statement, or other materials before taking action. Replace this placeholder with your formal DMCA contact process as needed.
15. No Professional Advice
The Service and outputs are provided for creative and informational purposes only. Nothing in the Service constitutes legal, medical, financial, professional, or other advice.
16. No Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all implied warranties to the maximum extent allowed by law, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
17. Limitation of Liability
To the maximum extent permitted by law, Radio Theater AI and its owners, operators, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for any loss of data, revenue, profits, goodwill, or business opportunities arising from or related to your use of the Service.
To the maximum extent allowed by law, our total liability for any claim related to the Service will not exceed the amount you paid to us for the Service giving rise to the claim during the twelve (12) months before the event first giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater if required by law.
18. Indemnification
You agree to defend, indemnify, and hold harmless Radio Theater AI and its owners, operators, employees, agents, affiliates, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your prompts, uploads, generated outputs, account activity, breach of these Terms, or violation of law or third-party rights.
19. Third-Party Terms
Your use of third-party services, including AI providers, payment processors, hosting services, and content delivery providers, may also be subject to those third parties’ own terms and policies. You are responsible for reviewing and complying with them.
20. Governing Law
These Terms and any dispute arising from them will be governed by the laws of the State of Utah, without regard to conflict-of-law principles, and subject to any mandatory venue or jurisdiction rules required by law.
